Terms and Conditions for Contracting the MOGU Platform
These terms and conditions regulate access and use of the MOGU platform, owned by MoguPlatform, S.L., a software specialized in travel management for travel agencies, which facilitates the submission and collection of reservations through a subscription system.
By hiring and using MOGU, you, hereinafter “THE AGENCY”, accept the following conditions:
1. Object of the Contract
MOGU is a technological tool that allows travel agencies to manage their operations for submitting and collecting travel reservations through an online platform.
The service includes the possibility of integrating a POS (Point of Sale Terminal) so that THE AGENCY receives the funds directly into its bank account.
MOGU does not act as an intermediary, operator or agent for the trips offered by THE AGENCY. Under no circumstances will MOGU be responsible for the organization, execution or quality of the trips offered by travel agencies.
2. Subscription Plans
MOGU offers subscription plans that can be purchased on a monthly or annual basis.
Access to the functionality and technical support of the platform will depend on the subscription plan contracted.
The rates and conditions associated with each plan are published on the official MOGU website and may be modified with 30 days' notice.
3. Cancellation of the Service
THE AGENCY may cancel your subscription at any time, without penalty.
Once canceled, access to the platform will continue until the end of the active billing period.
Before the cancellation, THE AGENCY may download all its content in PDF format.
Once the subscription is over, access to the platform and its content will be restricted, and MOGU will not guarantee the storage of the data.
4. Travel Responsibility
MOGU provides only the technological infrastructure for managing travel and payments.
It has no responsibility for the organization, execution or for any aspect related to the carrying out of the trips offered by THE AGENCY to its clients.
In addition, MOGU is not responsible for the processing, management or guarantee of payments made through the platform.
Any dispute, claim or incident related to payments, refunds or cancellations must be resolved directly between THE AGENCY and its clients.
THE AGENCY is solely responsible for the contractual relationship with its travelers and for compliance with all applicable laws and regulations.
5. Data Ownership and Responsibility
Data Ownership:
THE AGENCY is the owner and responsible for all data entered and managed on the MOGU platform, including customer, travel, booking and payment data. MOGU acts solely as a data processor for the provision of the contracted service.
Data Processing:
MOGU is committed to protecting the AGENCY's personal and commercial data in accordance with the General Data Protection Regulation (RGPD) and Spanish regulations on data protection.
The data will be processed exclusively for the provision of the service and will not be shared with third parties without the consent of THE AGENCY, unless necessary to comply with legal obligations.
Data Storage:
For the duration of the subscription, the data will be available to THE AGENCY on the platform.
In case of cancellation, THE AGENCY will have the option to download your data before the end of the service.
6. Level of Assistance and Support
Technical support and assistance will depend on the subscription plan contracted by THE AGENCY.
MOGU offers different levels of service depending on the plan (monthly or annual) and the functionalities associated with each one, detailed on the platform's website.
7. Updates and Maintenance
MOGU may make updates and improvements to the platform without prior notice in order to improve its performance or introduce new features.
These updates will be carried out automatically and will not require intervention by THE AGENCY.
MOGU undertakes to notify in advance any interruption of service for maintenance reasons.
8. Amendments to the Terms and Conditions
MOGU reserves the right to modify these terms and conditions.
In case of changes, THE AGENCY will be notified with 30 days' notice.
If THE AGENCY does not agree with the changes, you can cancel your subscription before the new conditions take effect.
9. Limitation of Liability
MOGU will not be responsible for any direct or indirect damage resulting from the use of the platform, including service interruptions, loss of data or technical problems.
MOGU does not guarantee that the platform is free of errors or failures, although it undertakes to resolve any technical issue within the stipulated deadlines according to the contracted subscription plan.
10. Jurisdiction and Applicable Law
This contract is governed by Spanish law.
Any controversy that arises in connection with the use of the MOGU platform will be resolved by the Courts and Tribunals of Granada, Spain.

MOGU offers subscription plans that can be contracted on a monthly or annual basis. Access to the platform's features and technical support will depend on the subscription plan contracted. The rates and conditions associated with each plan are published on the official MOGU website and may be modified with 30 days' prior notice.
3. Service cancellation
THE AGENCY may cancel its subscription at any time, without penalties. Once canceled, access to the platform will continue until the end of the active billing period. Before canceling, THE AGENCY may download all its content in PDF format. Once the subscription ends, access to the platform and its content will be restricted, and MOGU will not guarantee data storage.
4. Responsibility for trips
MOGU only provides the technological infrastructure to manage trips and payments. It has no responsibility for the organization, execution, or any aspect related to the execution of trips offered by THE AGENCY to its clients. Likewise, MOGU is not responsible for the processing, management, or guarantee of payments made through the platform. Any dispute, claim, or problem related to payments, refunds, or cancellations must be resolved directly between THE AGENCY and its clients. THE AGENCY is solely responsible for the contractual relationship with its travelers and for compliance with all applicable laws and regulations.
5. Data ownership and responsibility
Data ownership: THE AGENCY owns and is responsible for all data entered and managed on the MOGU platform, including client data, trips, bookings, and payments. MOGU only acts as a data processor to provide the contracted service.
Data processing: MOGU commits to protecting THE AGENCY's personal and commercial data as stipulated in the General Data Protection Regulation (GDPR) and Spanish data protection laws. Data will be processed solely for the provision of the service and will not be shared with third parties without THE AGENCY's consent, unless necessary to comply with legal obligations.
Data storage: During the term of the subscription, data will be available to THE AGENCY on the platform. In case of cancellation, THE AGENCY will have the option to download its data before the service ends.
6. Level of assistance and support

MOGU shall not be liable for any direct or indirect damages resulting from the use of the platform, including service interruptions, data loss, or technical issues. MOGU does not guarantee that the platform will be free from errors or failures, although it commits to resolving any technical incident within the times stipulated according to the contracted subscription plan.
10. Jurisdiction and applicable law
This contract is governed by Spanish law. Any dispute arising in connection with the use of the MOGU platform will be resolved by the courts of Granada (Spain). By subscribing to MOGU, THE AGENCY accepts the terms and conditions described.
