Términos y Condiciones para la Contratación de la Plataforma MOGU
Estos términos y condiciones regulan el acceso y uso de la plataforma MOGU, propiedad de MoguPlatform, S.L., un software especializado en la gestión de viajes para agencias de viajes, que facilita la presentación y el cobro de reservas mediante un sistema de suscripción.
Al contratar y utilizar MOGU, usted, en adelante “LA AGENCIA”, acepta las siguientes condiciones:
1. Objeto del Contrato
MOGU es una herramienta tecnológica que permite a las agencias de viajes gestionar sus operaciones de presentación y cobro de reservas de viajes a través de una plataforma online.
El servicio incluye la posibilidad de integrar un TPV (Terminal Punto de Venta) para que LA AGENCIA reciba los fondos directamente en su cuenta bancaria.
MOGU no actúa como intermediario, operador ni agente de los viajes ofrecidos por LA AGENCIA. En ningún caso MOGU será responsable de la organización, ejecución o calidad de los viajes ofrecidos por las agencias de viajes.
2. Planes de Suscripción
MOGU ofrece planes de suscripción que pueden contratarse de forma mensual o anual.
El acceso a las funcionalidades y al soporte técnico de la plataforma dependerá del plan de suscripción contratado.
Las tarifas y condiciones asociadas a cada plan se publican en la página web oficial de MOGU y podrán ser modificadas con un preaviso de 30 días.
3. Cancelación del Servicio
LA AGENCIA podrá cancelar su suscripción en cualquier momento, sin penalización.
Una vez cancelada, el acceso a la plataforma continuará hasta el final del período de facturación activo.
Antes de la cancelación, LA AGENCIA podrá descargar todo su contenido en formato PDF.
Finalizada la suscripción, el acceso a la plataforma y a su contenido quedará restringido, y MOGU no garantizará el almacenamiento de los datos.
4. Responsabilidad sobre los Viajes
MOGU proporciona únicamente la infraestructura tecnológica para la gestión de viajes y pagos.
No tiene ninguna responsabilidad sobre la organización, ejecución ni sobre ningún aspecto relacionado con la realización de los viajes ofrecidos por LA AGENCIA a sus clientes.
Asimismo, MOGU no es responsable del procesamiento, gestión ni garantía de los pagos realizados a través de la plataforma.
Cualquier disputa, reclamación o incidencia relacionada con pagos, reembolsos o cancelaciones deberá resolverse directamente entre LA AGENCIA y sus clientes.
LA AGENCIA es la única responsable de la relación contractual con sus viajeros y del cumplimiento de todas las leyes y normativas aplicables.
5. Propiedad y Responsabilidad sobre los Datos
Propiedad de los Datos:
LA AGENCIA es propietaria y responsable de todos los datos introducidos y gestionados en la plataforma MOGU, incluyendo datos de clientes, viajes, reservas y pagos. MOGU actúa únicamente como encargado del tratamiento de datos para la prestación del servicio contratado.
Tratamiento de Datos:
MOGU se compromete a proteger los datos personales y comerciales de LA AGENCIA conforme al Reglamento General de Protección de Datos (RGPD) y a la normativa española en materia de protección de datos.
Los datos serán tratados exclusivamente para la prestación del servicio y no serán compartidos con terceros sin el consentimiento de LA AGENCIA, salvo que sea necesario para cumplir con obligaciones legales.
Almacenamiento de Datos:
Durante la vigencia de la suscripción, los datos estarán disponibles para LA AGENCIA en la plataforma.
En caso de cancelación, LA AGENCIA tendrá la opción de descargar sus datos antes de que finalice el servicio.
6. Nivel de Asistencia y Soporte
El soporte técnico y la asistencia dependerán del plan de suscripción contratado por LA AGENCIA.
MOGU ofrece diferentes niveles de servicio según el plan (mensual o anual) y las funcionalidades asociadas a cada uno, detalladas en la página web de la plataforma.
7. Actualizaciones y Mantenimiento
MOGU podrá realizar actualizaciones y mejoras en la plataforma sin previo aviso con el objetivo de mejorar su rendimiento o introducir nuevas funcionalidades.
Estas actualizaciones se llevarán a cabo de forma automática y no requerirán intervención por parte de LA AGENCIA.
MOGU se compromete a notificar con antelación cualquier interrupción del servicio por motivos de mantenimiento.
8. Modificaciones de los Términos y Condiciones
MOGU se reserva el derecho de modificar los presentes términos y condiciones.
En caso de cambios, LA AGENCIA será notificada con un preaviso de 30 días.
Si LA AGENCIA no estuviera de acuerdo con las modificaciones, podrá cancelar su suscripción antes de que entren en vigor las nuevas condiciones.
9. Limitación de Responsabilidad
MOGU no será responsable de ningún daño directo o indirecto derivado del uso de la plataforma, incluyendo interrupciones del servicio, pérdida de datos o problemas técnicos.
MOGU no garantiza que la plataforma esté libre de errores o fallos, aunque se compromete a resolver cualquier incidencia técnica dentro de los plazos estipulados según el plan de suscripción contratado.
10. Jurisdicción y Ley Aplicable
El presente contrato se rige por la legislación española.
Cualquier controversia que surja en relación con el uso de la plataforma MOGU será resuelta por los Juzgados y Tribunales de Granada, España.
Al suscribirse a MOGU, LA AGENCIA acepta los términos y condiciones aquí descritos.
Terms and conditions for contracting the MOGU platform
These terms and conditions govern the access and use of the MOGU platform, owned by MoguPlatform, S.L., a software specialized in travel management for travel agencies, which facilitates the presentation and collection of bookings through a subscription system. By contracting and using MOGU, you, hereinafter referred to as "THE AGENCY," accept the following terms:
1. Purpose of the contract
MOGU is a technological tool that enables travel agencies to manage their operations for presenting and collecting travel bookings through an online platform. The service includes the possibility of integrating a POS (point-of-sale terminal) so that THE AGENCY receives funds directly into its bank account. MOGU does not act as an intermediary, operator, or agent for the trips offered by THE AGENCY. MOGU is not responsible under any circumstances for the organization, execution, or quality of the trips offered by travel agencies.
2. Subscription plans
MOGU offers subscription plans that can be contracted on a monthly or annual basis. Access to the platform's features and technical support will depend on the subscription plan contracted. The rates and conditions associated with each plan are published on the official MOGU website and may be modified with 30 days' prior notice.
3. Service cancellation
THE AGENCY may cancel its subscription at any time, without penalties. Once canceled, access to the platform will continue until the end of the active billing period. Before canceling, THE AGENCY may download all its content in PDF format. Once the subscription ends, access to the platform and its content will be restricted, and MOGU will not guarantee data storage.
4. Responsibility for trips
MOGU only provides the technological infrastructure to manage trips and payments. It has no responsibility for the organization, execution, or any aspect related to the execution of trips offered by THE AGENCY to its clients. Likewise, MOGU is not responsible for the processing, management, or guarantee of payments made through the platform. Any dispute, claim, or problem related to payments, refunds, or cancellations must be resolved directly between THE AGENCY and its clients. THE AGENCY is solely responsible for the contractual relationship with its travelers and for compliance with all applicable laws and regulations.
5. Data ownership and responsibility
Data ownership: THE AGENCY owns and is responsible for all data entered and managed on the MOGU platform, including client data, trips, bookings, and payments. MOGU only acts as a data processor to provide the contracted service.
Data processing: MOGU commits to protecting THE AGENCY's personal and commercial data as stipulated in the General Data Protection Regulation (GDPR) and Spanish data protection laws. Data will be processed solely for the provision of the service and will not be shared with third parties without THE AGENCY's consent, unless necessary to comply with legal obligations.
Data storage: During the term of the subscription, data will be available to THE AGENCY on the platform. In case of cancellation, THE AGENCY will have the option to download its data before the service ends.
6. Level of assistance and support
Technical support and assistance will depend on the subscription plan contracted by THE AGENCY. MOGU offers different service levels depending on the plan (monthly or annual) and the features associated with each, which are detailed on the platform's website.
7. Updates and maintenance
MOGU may perform updates and improvements to the platform without prior notice to improve performance or introduce new features. These updates will be carried out automatically and will not require any intervention by THE AGENCY. MOGU commits to providing advance notice of any service interruption for maintenance purposes.
8. Modifications to terms and conditions
MOGU reserves the right to modify these terms and conditions. In case of changes, THE AGENCY will be notified with 30 days' prior notice. If THE AGENCY does not agree with the modifications, it may cancel its subscription before the new terms take effect.
9. Limitation of liability
MOGU shall not be liable for any direct or indirect damages resulting from the use of the platform, including service interruptions, data loss, or technical issues. MOGU does not guarantee that the platform will be free from errors or failures, although it commits to resolving any technical incident within the times stipulated according to the contracted subscription plan.
10. Jurisdiction and applicable law
This contract is governed by Spanish law. Any dispute arising in connection with the use of the MOGU platform will be resolved by the courts of Granada (Spain). By subscribing to MOGU, THE AGENCY accepts the terms and conditions described.
